Consultation - End to commercial ‘grandfather’ rights

The prohibition of fishing in certain areas of the 0-6nm zone using boats in excess of certain size limits is fundamental to achieving the vision within the Wales Fisheries Strategy.

When restrictions were introduced, certain transitional provisions were included to ensure affected fishermen were not disproportionately affected by those new restrictions. Those transitional provisions took the form of exceptions which enabled boats over the prescribed size which meet certain criteria to continue to fish in the restricted area.   These transitional or exceptional provisions have become known as “historic” or “grandfather” rights.

Therefore the purpose of the consultation seeks views on the proposal to remove the exceptions within byelaws 38 and 9.  These byelaws relate to the former Sea Fisheries Committees in Wales.
