In terms of the Salmon and Freshwater Fisheries (Consolidation) (Scotland) Act 2003 (the Act), Scottish Ministers propose to make a conservation regulation under section 38 of the Act to protect early running spring salmon in Scotland. This follows the announcement by the Minister for Environment and Climate Change on 21 August 2014 that he would consult on statutory measures to replace and enhance the voluntary practices from previous years to address concerns about early running spring salmon.
